Welcome to Sparkly Studios. These Terms of Use ("Terms") govern your access to and use of sparklystudios.com (the "Site") and the products we sell. By using the Site or placing an order, you agree to these Terms.
1. Who we are
Sparkly Studios sells gemstone jewelry kits intended primarily for use by children with adult supervision. The Site is operated by Sparkly Studios, a small business based in the United States. Contact information is at the end of these Terms.
2. Eligibility
You must be at least 18 years old to purchase from the Site. By placing an order, you represent that you are 18 or older and have the legal capacity to enter into a binding contract.
Our products are intended for use by children with adult supervision. The buyer is responsible for selecting age-appropriate products and supervising use, including with respect to small parts.
3. Products and pricing
We do our best to describe our products and their materials accurately, but we don't guarantee that product descriptions, photographs, colors, or other content on the Site are error-free. Gemstones are natural materials and will vary in color, clarity, size, and inclusion. Each kit is one of a kind in this sense.
Prices are listed in US dollars and are subject to change at any time before you place an order. Promotional pricing may be limited and is honored only when ordered during the promotional period.
4. Orders and payment
When you place an order, you're making an offer to purchase. We reserve the right to accept or decline your order for any reason, including product unavailability, errors in pricing or product information, or suspected fraud. If we decline an order after payment, we'll refund you in full.
Payment is processed at checkout through Shopify and our payment processors. By providing payment information, you authorize us to charge the listed amount.
5. Shipping, delivery, and risk of loss
Shipping timelines and costs are shown at checkout. Estimated ship dates are estimates, not guarantees, and can shift due to inventory, supplier, or carrier delays. We'll do our best to keep you updated.
Risk of loss passes to you when the package is delivered to the carrier (i.e., once it leaves our hands and goes to the shipping company). If your package is lost or damaged in transit, contact us at support@sparklystudios.com and we'll work with you to resolve it.
6. Returns and refunds
No returns (final sale): All sales are final. Because each kit contains gemstones and components that can be opened, used, or replaced, we don't accept returns or exchanges. If your kit arrives damaged or incomplete, contact us within 14 days of delivery at support@sparklystudios.com and we'll make it right.
If your kit arrives damaged, defective, or incomplete (regardless of return policy above), contact us within 14 days of delivery and we'll replace it or refund you.
7. Children's product safety
Our kits are recommended for ages 5 and up, with adult supervision. Kits contain small parts and are not suitable for children under 3. Children's jewelry can present a choking hazard. We require that an adult supervise use throughout, follow the age recommendations and instructions included in the kit, and store unused components out of reach of younger children.
By purchasing, you acknowledge that you are responsible for selecting age-appropriate products for the intended user, supervising use, and keeping small components away from children under 3.
8. Intellectual property
All content on the Site (including product names, designs, logos, photography, written copy, and the "Sparkly Studios" name and marks) is owned by us or licensed to us, and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any of it without our written permission, except that you may share product photos and our content on social media in a way that credits Sparkly Studios.
The finished jewelry your child makes is, of course, theirs to keep, wear, and treasure.
9. User content
If you submit reviews, photos, comments, or other content to the Site or tag us on social media, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display that content in connection with our marketing and operations, with credit to you where reasonable. You represent that you have the right to submit the content and that it doesn't infringe anyone else's rights.
We reserve the right to remove user content at our discretion.
10. Disclaimers
The Site and all products are provided "as is" and "as available." To the fullest extent permitted by law, Sparkly Studios disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Gemstones are natural and may vary. Findings (clasps, jump rings, wires) are made of gold-filled and sterling silver. While these materials are generally well-tolerated, if you or the intended user has a known metal sensitivity, please review the product description before purchasing.
11. Limitation of liability
To the fullest extent permitted by law, Sparkly Studios will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Site or our products. Our total liability for any claim arising out of or relating to these Terms or our products will not exceed the amount you paid for the product giving rise to the claim.
Some jurisdictions don't allow limitations of liability, so portions of this section may not apply to you.
12. Governing law and disputes
These Terms are governed by the laws of the United States. Any dispute arising out of or relating to these Terms or your use of the Site will be resolved through good-faith communication first. If a dispute can't be resolved that way, it will be handled in a court of competent jurisdiction in the United States.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top. Your continued use of the Site after we post changes means you accept the updated Terms.
